INSURANCE LAW
Eight months after the riots that ravaged this antipodean French territory, insured companies are facing up to their insurers.
The technical and legal realities remain:
- Guarantees that are often outdated and ill-suited to companies’ real risks, both in terms of amounts and the existence of certain guarantees.
- Questions about the quality of the advice provided by certain insurance intermediaries in setting up cover and contracts for their customers.
- Frequent failure to regularly re-evaluate risks, and therefore guarantees
- Weak formalization of certain negotiated guarantees, making it difficult to prove their existence on the day of a claim.
- Insurance market reduced to a very small number of companies
- Future refusal of insurance in many parts of the country
I intervene on behalf of New Caledonian companies to defend their interests against their insurers.
